Terms of Service

Article 1 (Purpose)

These terms and conditions (hereinafter referred to as "Terms") are intended to stipulate the rights, obligations, and responsibilities between the operator (hereinafter referred to as "Operator"), which is Seoul Smart Co., Ltd., and the customer (hereinafter referred to as "User"), who uses the International Taxi Service (hereinafter referred to as "Service") operated by the Operator or makes a reservation for using the Service through a separate agreement.

Article 2 (Definition of Terms)

The definitions of the terms used in these Terms are as follows:

  1. "Operator" refers to Seoul Smart Co., Ltd. or its entrusted party that mediates the conclusion of transportation contracts between "Users" and drivers performing "Service" operations by accepting applications for "Service" and ancillary services from "Users".
  2. "User" refers to a person who agrees to these Terms and intends to use the "Service" and ancillary services, including passengers who actually board the International Taxi vehicles.
  3. "Service" refers to a service that mediates the conclusion of transportation contracts by accepting transportation requests from "Users" and notifying drivers who will perform "Service" operations, and ancillary services refer to services provided by the "Operator" or International Taxi drivers for the convenience of "Users" in relation to the "Service".

Article 3 (Application of Terms)

The scope and content of these Terms are as follows:

  1. These Terms apply only to International Taxi reservations and ancillary services using the "Service" provided by the "Operator".
  2. If it is necessary to conclude a separate contract in addition to these Terms, the "Operator" and the "User" may enter into an additional usage agreement.
  3. In the case where a separate usage agreement is concluded between the "Operator" and the "User" pursuant to the above item 2, the contents stipulated in this Terms shall apply with priority, and matters not separately stipulated shall be applied according to the contents of this Terms.

Article 4 (Timing of Reservation and Contract Formation)

The transportation reservation or ancillary service usage contract is formed according to the following items.

  1. When the "User" requests a transportation reservation and ancillary service usage through the official "Service" reservation channels (such as phone or internet) of International Taxi and receives a reservation number.
  2. When a separate usage agreement is concluded.
  3. When the "Operator" receives a separate deposit related to the use of the "Service" and ancillary services on behalf of the International Taxi driver, and the payment is confirmed through deposit or card payment, etc.

Article 5 (Agreement to Terms)

The "Operator" considers that the "User" has agreed to these Terms when the usage contract is established and concluded according to Article 4, and applies these Terms.

Article 6 (Types of Transportation Fees)

The types of transportation fees are as follows, and detailed transportation fees are separately posted on the official International Taxi website (www.intltaxi.co.kr).

  1. Meter Fare System: A fare system calculated based on the current meter fare.
  2. Zone Fare System: A fare system applied for specific route operations and chartered operations.

Article 7 (Privacy Protection)

The "Operator" cannot use or provide the personal information obtained in connection with the "User"'s use of the "Service" to third parties without the "User"'s consent, and all responsibility for any violation of this lies with the "Operator". However, exceptions are made in the following cases.

  1. When providing the "User"'s personal information necessary for transportation reservation or ancillary service use to the driver performing the "Service" or the ancillary service provision outsourcing agency designated by the "Operator".
  2. When providing in a form that cannot identify a specific individual when necessary for the preparation of related statistics, academic research, and market research.
  3. When there is an obligation to provide in accordance with other relevant laws and regulations.

Article 8 (Operator's Obligations)

The "Operator"'s obligations are as follows.

  1. The "Operator" does not engage in prohibited acts under relevant laws and these Terms, and provides the "Service" and ancillary services continuously and stably as defined in these Terms.
  2. The "Operator" establishes a security system to protect the personal information of "Users" so that "Users" can safely use the "Service".
  3. The "Operator" has a duty of care as a manager regarding the provision of the "Service" and ancillary services.

Article 9 (User's Obligations)

The "User"'s obligations are as follows.

  1. The "User" must comply with the relevant laws and the contents of these Terms, the "Service" usage guide, and other matters announced or notified by the "Operator", and must not engage in any acts that interfere with the work of the "Operator" and the driver performing the "Service".
  2. The "User" agrees to receive emails, SMS (text messages), and phone calls related to the use of the "Service".
    • Providing false information when applying for the use of the "Service" and ancillary services.
    • Using the information obtained when using the "Service" and ancillary services to apply for or conclude individual or separate transportation reservations and contracts with drivers performing the "Service".
    • Other acts that interfere with the work of the "Operator" and drivers performing the "Service".
  3. The "User" agrees to provide the personal information necessary for the use of the "Service" and ancillary services.
  4. After completing a transportation reservation using the "Service", if the "User" needs to change or cancel the reservation, they must notify the "Operator" of the change or cancellation at least 3 hours before the scheduled start of the reserved transportation. If the "User" fails to fulfill this notification obligation, the "Operator" may not refund all or part of the deposit.

Article 10 (Provision of Information)

The following information may be provided for the smooth operation of the "Service".

  1. The "Operator" may provide necessary information for the smooth use of the "Service" and ancillary services to "Users" through email, SMS (text messages), and phone calls.
  2. The "Operator" may outsource part of the "Service" and ancillary service operations to an outsourcing agency, and the "Operator" may provide "User" information related to the use of the "Service" and ancillary services to the outsourcing agency.

Article 11 (Usage Time)

The usage time of the "Service" is defined as follows.

  1. The "Service" is generally available 24/7, unless there are special circumstances related to the "Operator's" business or technical reasons.
  2. If the "Service" usage time changes, the "Operator" will post it on the official International Taxi website (www.intltaxi.co.kr) to inform users.

Article 12 (Refusal of Transportation Reservation)

The "Operator" may refuse transportation reservation requests in the following cases.

  1. When dispatch is not possible at the time the "User" requests a transportation reservation.
  2. When the "User" has violated these Terms more than twice.
  3. When normal reservation and use of the "Service" and ancillary services is not possible due to system failure, etc.
  4. When there are significant changes in relevant laws and regulations, Seoul Metropolitan Government policies, etc.
  5. When transportation is not possible due to other force majeure reasons such as natural disasters.

Article 13 (Scope of Operator's Responsibility and Exemption)

The scope of the "Operator"'s responsibility and exemption is defined as follows.

  1. In relation to the operation of the "Service", the "Operator" may be liable for actual damages within the scope of the amount deposited by the "User" in the following cases.
    • When the "Operator" provides the "Service" differently from the transportation and reservation details of the "User"'s "Service" and ancillary services, or confirms the reservation and dispatch differently.
    • When the "Operator" receives a notification from the driver performing the "Service" that it is not possible to conclude a transportation contract due to a change in circumstances after the "User" completes a transportation reservation, but fails to notify the "User" of that fact in advance. However, if prior notification is not smoothly made due to the "User"'s circumstances making contact impossible, the "Operator" is not liable.
  2. The "Operator" is not responsible for any damages caused by the following acts of the driver performing the "Service" in relation to the "User"'s use of the "Service".
    • Non-fulfillment of obligations under a transportation contract that has been successfully completed.
    • Illegal acts
  3. The "Operator" is not responsible for damages caused by the "User's" intentional or negligent actions and damages caused by failure to comply with these Terms.
  4. The "Operator" is also not responsible for damages caused when the "Service" is unavailable due to unavoidable reasons such as natural disasters and system failures.
  5. The "Operator" may record the "User"'s "Service" usage history in relation to the scope of responsibility.

Article 14 (Copyright Attribution and Use Restrictions)

All rights to the property rights, copyrights, and other intellectual property rights of all deliverables produced and output by the "Operator" belong to the "Operator".

Article 15 (Dispute Resolution)

The "Operator" strives to resolve disputes as follows.

  1. The "Operator" actively listens to and strives to promptly address legitimate opinions or complaints raised by "Users".
  2. When receiving specific damage cases that occurred during the non-fulfillment of transportation contracts or the provision of the "Service", the "Operator" strives to facilitate a smooth agreement between the "User" and the driver performing the "Service".

Article 16 (Notice and Changes to Terms of Use)

The "Operator" may notify or change the Terms of Use as follows.

  1. The "Operator" posts the contents of the Terms of Use on the official International Taxi website (www.intltaxi.co.kr).
  2. When changing the Terms of Use, it is posted on the official International Taxi website (www.intltaxi.co.kr), and the changed terms take effect 14 days after the posting date.

Article 17 (Jurisdiction)

In principle, disputes arising from these Terms should be resolved through mutual agreement. However, if there is litigation related to these Terms, the jurisdiction shall be the court that has jurisdiction over the location of the "Operator".
